O acolhimento de crianças e adolescentes como medida de proteção social: dilemas e contradições

Abstract

A institucionalização de crianças e adolescentes que vivenciam violação de direitos tem sido discutida no âmbito do desenvolvimento de políticas públicas e no meio acadêmico, neste, timidamente. Tais discussões visam elaborar diretrizes que garantam o direito à convivência familiar e comunitária e evidenciam um campo em reordenamento. Objetivou-se, com esta pesquisa, analisar os pressupostos que fundamentam e orientam a institucionalização/acolhimento de crianças e adolescentes como medida de proteção social no Brasil a partir de suas regulamentações e concepções teóricas orientadoras. O estudo teve como objetivos específicos: \"Compreender historicamente as concepções legais e sociais de infância, criança e adolescente, e de que forma elas conformam no percurso histórico a medida de proteção acolhimento; Investigar nos marcos legais e em referenciais teóricos como se constituiu a cultura da institucionalização de crianças e adolescentes como política de proteção social; Identificar de que forma o direito à convivência familiar e comunitária como um princípio e uma estratégia de proteção social às crianças, adolescentes e suas famílias vem sendo observado e utilizado nas políticas sociais contemporâneas\". Foram utilizados como referência as legislações nacionais e marcos legais internacionais, além de referenciais teóricos que fundamentam e orientam a regulamentação e aplicação de práticas recentes e/ou vigentes. A questão problema que orientou esta pesquisa foi: \"Quais são os pressupostos que fundamentam e orientam a institucionalização de crianças e adolescentes como medida de proteção social e como esta influencia nos arranjos politico-institucionais vigentes?\". A pesquisa documental e a pesquisa bibliográfica foram eleitas como procedimentos metodológicos. Na primeira etapa utilizamos os referenciais teóricos e as legislações eleitas para compreender historicamente as concepções de infância e criança, e de que maneira elas conformam/conformavam a institucionalização/acolhimento como medida de proteção social. Na segunda etapa foi feito um levantamento das legislações, marcos legais nacionais e internacionais que regulamentam no Brasil o atendimento à criança e ao adolescente tendo a institucionalização como medida de proteção social. Na terceira etapa considerou-se o Plano Nacional de Promoção, Defesa e Garantia do Direito de Crianças e Adolescentes à Convivência Familiar e Comunitária (PNCFC) como documento base para identificar de que forma o direito à convivência familiar e comunitária é aplicado ou não como um princípio e uma estratégia de proteção social às crianças, adolescentes e suas famílias. Na quarta e última etapa realizou-se o tratamento, análise e interpretação dos dados norteando-se numa perspectiva sócio-histórica, pautada em categorias fundamentadas teoricamente. Os dados e informações obtidos pela pesquisa foram interpretados por meio da análise de conteúdo. Concluiu-se que mesmo com o significativo avanço das legislações para garantir o Direito a convivencia familiar e comunitária à crianças e adolescentes que tenham seus direitos violados nas relações intrafamiliares, o atendimento a eles dispensado os coloca de volta frente a cultura da institucionalização, que a muito tem sido vista como forma de proteção social; as políticas vigentes evidenciam que o acolhimento está intrisicamente relacionado a classe social, ao gênero e a cor/raça destas crianças e adolescentes, além disso ficam relegadas ao acolhimento àquelas pertencentes as famílias classificadas como \"negligentes\". Nos estudos realizados percebeu-se ainda que, ao fomentar uma nova cultura de acolhimento, são necessárias mudanças nas concepções de infância, nas significações de famílias e nas políticas de assistência à infância e a adolescência.

Abstract: The institutionalization of children and adolescents who experience violation of rights has been discussed in the context of the development of public policies and in the academic environment, in this, timidly. These discussions aim to develop guidelines that guarantee the right to family and community coexistence and evidence a field in reordering. The objective of this research was to analyze the assumptions that underlie and guide the institutionalization/reception of children and adolescents as a measure of social protection in Brazil based on its regulations and theoretical guiding conceptions. The study had as its specific objectives: \"Historically understand the legal and social conceptions of childhood, child and adolescent, and how they form in the historical path the measure of protection of welcoming; Investigate in the legal frameworks and theoretical references how the culture of institutionalization of children and adolescents was constituted as a social protection policy; To identify how the right to family and community coexistence as a principle and a strategy of social protection to children, adolescents and their families has been observed and used in contemporary social policies. \"National laws and international legal frameworks were used as reference, as well astheoretical references that support and guide the regulation and application of recent and/or current practices. The problem question that guided this research was: \"What are the assumptions that underlie and guide the institutionalization of children and adolescents as a measure of social protection and how does it influence the current political-institutional arrangements?\". Documentary research and bibliographic research were chosen as methodological procedures. In the first stage we used the theoretical references and the legislations chosen to understand historically the conceptions of childhood and child, and how they conformed/conformed institutionalization/reception as a measure of social protection. In the second stage, a survey of the legislations, national and international legal frameworks that regulate in Brazil the care of children and adolescents, with institutionalization as a measure of social protection. In the third stage, the National Plan for the Promotion, Defense and Guarantee of the Right of Children and Adolescents to Family and Community Coexistence (PNCFC) was considered as a basic document to identify how the right to family and community coexistence is applied or not as a principle and a strategy of social protection to children, adolescents and their families. In the fourth and final stage, the treatment, analysis, and interpretation of the data was carried out, guided by a socio-historical perspective, based on theoretically based categories. The data and information obtained by the research were interpreted through content analysis. It was concluded that even with the significant advance of legislation to guarantee the right to family and community life for children and adolescents who have their rights violated in intrafamily relationships, the care provided to them puts them back in front of the culture of institutionalization, which has long been seen as a form of social protection; the current policies show that the reception is intrinsically related to the social class, gender and color/race of these children and adolescents, and is also relegated to the reception of those belonging to the families classified as \"negligent\". In the studies carried out, it was also noticed that, by fostering a new culture of welcoming, changes are necessary in the conceptions of childhood, in the meanings of families and in the policies of childcare and adolescence.
