Tribunal de Justiça do Estado de São Paulo e intérpretes de Libras­-Português: uma análise das intersecções do uso do gênero acórdão e implicações profissionais para contextos judiciais

Abstract

Os intérpretes de Libras-Português no sistema judicial brasileiro desempenham papel imprescindível na promoção do acesso à justiça das pessoas surdas, ao contribuírem para a garantia de seus direitos linguísticos. Considerando que esses direitos vêm sendo pleiteados de forma recorrente no Poder Judiciário, o mapeamento do uso do gênero acórdão mostra-se um caminho assertivo para compreender suas interseções com tais direitos. Além do mapeamento desse gênero textual jurídico, torna-se necessário assegurar uma interpretação qualificada e segura, bem como fortalecer a formação profissional dos intérpretes de Libras Português que atuam no âmbito judicial. Nesse contexto, dois grandes campos dialogam de maneira estreita: os Estudos da Interpretação e o Direito, articulados pelas contribuições do Direito Linguístico e pelo estudo dos gêneros textuais jurídicos. Diversos autores sustentam essa articulação e expandem conceitos teóricos relacionados aos direitos linguísticos e aos Estudos da Interpretação, entre eles Abreu (2018, 2020), Santos (2018), Sigales-Gonçalves (2020) e Goulart e Santos (2021). No que se refere aos gêneros textuais jurídicos, destacam-se trabalhos de Goulart (2020), Goulart e Santos (2021), Sousa e Santos (2022) e Ramos (2023). Por essa ótica, o presente estudo dedica-se à análise do gênero acórdão do Tribunal de Justiça do Estado de São Paulo (TJSP), oferecendo aos profissionais dos Estudos da Interpretação subsídios para a segurança interpretativa e para o empoderamento profissional. Essa análise contempla também a representação do intérprete de Libras-Português como agente da garantia de direitos linguísticos das pessoas surdas no contexto judicial. Metodologicamente, o estudo envolveu a coleta e análise documental de acórdãos e a quantificação dos direitos linguísticos neles mencionados, assumindo caráter descritivo ao examinar estruturas e características desse gênero textual jurídico. A pesquisa documental consistiu na análise de jurisprudências do TJSP a partir de seus acórdãos. A sistematização inicial resultou em 160 acórdãos; após refinamento, 117 foram selecionados para análise, distribuídos nas seguintes categorias: (i) Gênero Discursivo Acórdão; (ii) os direitos linguísticos das comunidades surdas e implicações para os intérpretes de Libras-Português; (iii) intérpretes de Libras Português e acórdãos: desafios e distorções terminológicas; e (iv) reflexos e impactos na atuação profissional dos intérpretes de Libras-Português. Os resultados indicam que os acórdãos refletem e impactam os direitos linguísticos das pessoas surdas, constituindo um instrumento para a segurança interpretativa nas tomadas de decisão e para o empoderamento dos intérpretes que atuam no Judiciário. Evidenciou-se que os gêneros textuais jurídicos estabelecem diálogos profícuos com o Direito Linguístico, ao permitir análises de práticas sociais, formativas e textuais, contribuindo para a articulação entre os Estudos da Interpretação e o Direito. Conclui-se que esse estudo amplia o alcance dos Estudos da Interpretação ao articulá-los com os direitos linguísticos, por meio da análise de gêneros textuais e discursivos jurídicos. Essa aproximação favorece a profissionalização, o empoderamento e a valorização dos intérpretes de Libras-Português, além de fortalecer a segurança interpretativa e qualificar a formação e atuação desses profissionais no contexto jurídico.

Abstract: Brazilian Sign Language (Libras) interpreters in the Brazilian judicial system play an essential role in promoting access to justice for deaf people by helping to guarantee their linguistic rights. Considering that these rights have been repeatedly claimed in the Judiciary, mapping the use of the judgment genre is an assertive way to understand its intersections with such rights. In addition to mapping this legal text genre, it is necessary to ensure qualified and reliable interpretation, as well as to strengthen the professional training of Libras-Portuguese interpreters working in the judicial sphere. In this context, two major fields are closely intertwined: Interpreting Studies and Law, linked by the contributions of Linguistic Law and the study of legal text genres. Several authors support this articulation and expand theoretical concepts related to linguistic rights and Interpreting Studies, among them Abreu (2018, 2020), Santos (2018), Sigales-Gonçalves (2020), and Goulart and Santos (2021). With regard to legal text genres, the works of Goulart (2020), Goulart and Santos (2021), Sousa and Santos (2022), and Ramos (2023) stand out. From this perspective, the present study is dedicated to the analysis of the judgment genre of the Court of Justice of the State of São Paulo (TJSP), offering professionals in the field of Interpreting Studies support for interpretative certainty and for professional empowerment. This analysis also considers the role of the Libras-Portuguese interpreter as an agent for guaranteeing the linguistic rights of deaf people in the judicial context. Methodologically, the study involved the collection and analysis of court rulings and the quantification of the linguistic rights mentioned therein, taking on a descriptive character when examining the structures and characteristics of this legal text genre. The documentary research consisted of analyzing the jurisprudence of the TJSP based on its judgments. The initial systematization resulted in 160 judgments; after refinement, 117 were selected for analysis, distributed in the following categories: (i) Discursive Genre Judgment; (ii) the linguistic rights of deaf communities and implications for Libras-Portuguese interpreters; (iii) Libras Portuguese interpreters and judgments: challenges and terminological distortions; and (iv) reflections and impacts on the professional performance of Libras Portuguese interpreters. The results indicate that court rulings reflect and impact the linguistic rights of deaf people, constituting an instrument for interpretive security in decision-making and for the empowerment of interpreters working in the judiciary. It was evident that legal text genres establish fruitful dialogues with Linguistic Law, allowing for analyses of social, formative, and textual practices, contributing to the articulation between Interpreting Studies and Law. It can be concluded that this study broadens the scope of Interpreting Studies by linking them to linguistic rights through the analysis of legal textual and discursive genres. This approach promotes the professionalization, empowerment, and recognition of Libras-Portuguese interpreters, in addition to strengthening interpretive confidence and improving the training and performance of these professionals in the legal context.
