Diferenças entre a inteligência de segurança pública e a investigação criminal

Abstract

A Inteligência Policial e a Investigação Criminal possuem relevância para o fortalecimento do Estado Democrático de Direito e a eficácia da persecução penal no Brasil. Entretanto, possuem diferenças conceituais, metodológicas e legais. De um lado, a Inteligência Policial é atividade consultiva e proativa, regida pelo Ciclo de Produção do Conhecimento. De outro, a Investigação Criminal tem caráter reativo e formal, conduzida pelo inquérito policial. Na discussão do tema, elencou-se o seguinte questionamento: quais as distinções entre Investigação Criminal e Inteligência Policial e de que forma elas influem na validação probatória do processo penal? A hipótese verificada é a de que essa delimitação é crucial para prevenir nulidades processuais e assegurar a validade jurídica das provas. O objetivo geral consiste em analisar tais diferenças apontando sua relevância teórica e legal. Os objetivos específicos buscam conceituar os institutos, identificar divergências operacionais e analisar desdobramentos jurídicos da confusão entre as matérias. Como metodologia, adota-se abordagem qualitativa por meio de revisão bibliográfica narrativa, exploratória e descritiva, com exame de doutrina especializada, legislação pertinente e jurisprudência dos tribunais superiores.

Police intelligence and criminal investigation are relevant to strengthening the democratic rule of law and the effectiveness of criminal prosecution in Brazil. However, they have conceptual, methodological, and legal differences. On the one hand, police intelligence is a consultative and proactive activity, governed by the Knowledge Production Cycle. On the other hand, criminal investigation has a reactive and formal character, conducted through the police inquiry. In discussing the topic, the following question was raised: what are the distinctions between criminal investigation and police intelligence, and how do they influence the evidentiary validation of the criminal process? The hypothesis verified is that this delimitation is crucial to prevent procedural nullities and ensure the legal validity of evidence. The general objective is to analyze these differences, pointing out their theoretical and legal relevance. The specific objectives seek to conceptualize the institutions, identify operational divergences, and analyze the legal implications of the confusion between the subjects. As a methodology, a qualitative approach is adopted through a narrative, exploratory, and descriptive bibliographic review, with an examination of specialized doctrine, relevant legislation, and jurisprudence of the superior courts.
