Gestão e legislação migratória brasileira nas migrações haitiana e venezuelana

Abstract

O trabalho tem como objetivo analisar como o Brasil respondeu aos fluxos migratórios de haitianos e de venezuelanos, e, em especial, verificar se a gestão migratória brasileira atual está articulada com a Lei de Migração. Para isso apresenta os estudos de casos das migrações haitiana e venezuelana ao Brasil. Relata a evolução da legislação migratória brasileira no período de 1808 a 2018, através da exposição dos aspectos teóricos e conceituais da migração, assim como dos principais instrumentos na ordem jurídica nacional, como o Estatuto do Estrangeiro, a Lei de Migração e a Lei de Refúgio. Em seguida, expõe para cada estudo de caso, tanto a gestão migratória brasileira quanto as legislações aplicadas, demonstrando como o governo federal atuou na regularização, acolhida e interiorização desses grupos. Dessa forma, a metodologia empregada é o estudo de caso. Ademais, o trabalho utiliza, como técnica de pesquisa, bibliografias e documentações. Como resultado e conclusão, verifica-se que a gestão migratória brasileira evoluiu quando se compara o tratamento despendido aos fluxos haitiano e venezuelano, bem como que a atuação do governo federal na gestão migratória atual não está completamente articulada com a lei de migração.

Abstract : The paper aims to analyze how Brazil responded to the migratory flows of Haitians and Venezuelans, and in particular, to verify if the current Brazilian migratory management is articulated with the Migration Law. For this, is presented the case studies of Haitian and Venezuelan migrations to Brazil. Is reported the evolution of Brazilian immigration legislation from 1808 to 2018, through the presentation of the theoretical and conceptual aspects of migration, as well as the main instruments in the national legal order, such as the Statute of the Foreigner, the Migration Law and the Refugee Law. Then, is presented for each case study, both the Brazilian migratory management and the applied legislation, demonstrating how the federal government acted on the regularization, acceptance and internalization of these groups. In this way, the methodology used is the case study. In addition, the work uses, as research technique, bibliographies and documentation. In result and conclusion, it is verified that the Brazilian migratory management evolved when comparing the treatment expended to the Haitian and Venezuelan flows, as well as that the performance of the federal government in the current migration management is not fully articulated with the migration law.
