Sexualidade no contexto neoliberal: o mercado virtual pornográfico e suas implicações aos direitos das mulheres

Abstract

A presente pesquisa tem como objeto a análise das implicações do mercado virtual pornográfico - enquanto discurso audiovisual - aos direitos das mulheres, em especial sexuais. Para tal, parte-se do conceito de política cultural dos direitos humanos, segundo o qual inquirir sobre sua efetividade exige considerar sua produção cotidiana. Tendo isso em conta, a investigação, de caráter exploratório, baseia-se tanto em pesquisas bibliográficas quanto empíricas acerca do mercado, bem como se desenvolve por intermédio da operação de categorias psicanalíticas. Como objetivos, tem-se: 1. localizar histórica e social do surgimento e consolidação do mercado virtual pornográfico em associação ao neoliberalismo; 2. identificar os estereótipos raciais e de gênero que reverbera; 3. aprofundar a análise, com a operacionalização da psicanálise, da produção de sentidos que constituem seu discurso, problematizando-o em relação aos direitos das mulheres. Para tal, explora-se o conceito de imaginário social e de imaginário(s) sob a perspectiva da psicanálise, em articulação com sua leitura sobre a subjetividade neoliberal e sobre o corpo nas dimensões simbólica e imaginária. Em um segundo momento, apresenta-se o percurso histórico dos direitos sexuais e reprodutivos, abordando diversos marcos normativos, como a Convenção para a Eliminação de Todas as Formas de Discriminação contra a Mulher (CEDAW) e discute-se sua efetividade à luz da política cultural dos direitos. Conclui-se, por fim, que o mercado virtual pornográfico atua como um discurso normatizador que restringe, por vias latentes, o exercício da sexualidade das mulheres, não visando desconstruir normativamente seus direitos já conquistados, mas restringi-los através da política cultural, ao reforçar um imaginário patriarcal e estereotipante que as discrimina. Contudo, alerta-se que esta não é uma consequência direta da pornografia, mas sim um efeito da sobreposição entre a constituição da subjetividade no neoliberalismo - que inflama a dimensão imaginária do corpo e demanda uma performance a ser perseguida -, a falta de educação sexual e a ampla naturalização da hierarquia de gênero. Todos esses fatores colocam o mercado virtual pornográfico na posição de ?mestre? no campo do sexual, o que, além de outras problemáticas apontadas, colabora para a redução da efetividade dos direitos sexuais das mulheres. De outro lado, o trabalho argumenta acerca do potencial uso da pornografia para conter atos violentos, advertindo os(as) leitores(as) acerca dos riscos da simplificação da dinâmica entre fantasias e atos. Finalmente, apresentam-se horizontes de atuação sociopolítica sob o ponto de vista da garantia dos direitos das mulheres, como a proposição em torno da regulação administrativa das plataformas e a ampliação da educação sexual. Em suma, entende-se que não se consegue separar a vivência da sexualidade do imaginário que a integra, de forma que o exercício autônomo da sexualidade pelas mulheres depende da sua posição de sujeito e do afastamento de um imaginário de sujeição feminina no qual o consentimento não é relevante - ideia que a pornografia tradicional insiste em repetir.

Abstract: The present research aims to analyze the implications of the virtual pornographic market - as an audiovisual discourse - for women's rights, especially sexual ones. To this end, it departs from the concept of cultural politics of human rights, according to which inquiring into its effectiveness requires considering its daily production. Taking this into account, the investigation, of an exploratory nature, is based on both bibliographical and empirical research about the market, as well as developing through the operation of psychoanalytic categories. The objectives are: 1. to locate the historical and social history of the emergence and consolidation of the virtual pornographic market in association with neoliberalism; 2. identify the racial and gender stereotypes that it reverberates; 3. deepen the analysis, with the operationalization of psychoanalysis, of the production of meanings that constitute its speech, problematizing it in relation to women's rights. To this end, the concept of social imaginary and imaginary(s) is explored from the perspective of psychoanalysis, in conjunction with its reading of neoliberal subjectivity and the body in the symbolic and imaginary dimensions. Secondly, the historical trajectory of sexual and reproductive rights is presented, addressing various normative frameworks, such as the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW) and its effectiveness is discussed considering the cultural politics approach on rights. Finally, it is concluded that the virtual pornographic market acts as a normative discourse that restricts, in latent ways, the exercise of women's sexuality, not aiming to normatively deconstruct their already conquered rights, but to restrict them through cultural politics, by reinforce a patriarchal and stereotyping imaginary that discriminates against them. However, it is important to note that this is not a direct consequence of pornography, but rather an effect of the overlap between the constitution of subjectivity in neoliberalism - which inflames the imaginary dimension of the body and demands a performance to be pursued -, the lack of sexual education and the broad naturalization of the gender hierarchy. All these factors place the virtual pornographic market in the position of ?master? in the sexual field, which, in addition to other problems highlighted, contributes to reducing the effectiveness of women's sexual rights. On the other hand, the work argues about the potential use of pornography to contain violent acts, warning readers about the risks of simplifying the dynamics between fantasies and acts. Finally, horizons of sociopolitical action are presented from the point of view of guaranteeing women's rights, such as the proposition surrounding the administrative regulation of platforms and the expansion of sexual education. In short, it is understood that it is not possible to separate the experience of sexuality from the imaginary that integrates it, so that the autonomous exercise of sexuality by women depends on their position as subject and the distancing of an imaginary of female subjection in which consent is not relevant - an idea that traditional pornography insists on repeating.
