O impacto do filtro da relevância no juízo de admissibilidade do recurso especial e suas implicações no acesso à justiça e segurança jurídica

Abstract

O presente trabalho analisa os impactos da inclusão do filtro da relevância, estabelecido pela Emenda Constitucional 125/2022, no sistema processual brasileiro, com foco nas implicações para o acesso à justiça e a segurança jurídica. A pesquisa aborda o impacto desse mecanismo, que limita o acesso ao Superior Tribunal de Justiça (STJ), no equilíbrio entre a eficiência do recurso especial, o acesso à justiça e a segurança jurídica. Primeiramente, discutimos o contexto histórico e os princípios do recurso especial, enfatizando seu papel de padronizar a interpretação da legislação infraconstitucional. Depois, analisam-se as regras e consequências do filtro de relevância, destacando os desafios práticos e teóricos resultantes de sua implementação. Finalmente, a pesquisa analisa os impactos dessa alteração na uniformidade das decisões judiciais e na salvaguarda dos direitos fundamentais.

This study analyzes the impacts of the inclusion of the relevance filter, established by Constitutional Amendment 125/2022, on the Brazilian procedural system, focusing on its implications for access to justice and legal certainty. The research examines the effects of this mechanism, which limits access to the Superior Court of Justice (STJ), on the balance between the efficiency of the special appeal, access to justice, and legal certainty. Firstly, it discusses the historical context and principles of the special appeal, emphasizing its role in standardizing the interpretation of infraconstitutional legislation. Subsequently, the rules and consequences of the relevance filter are analyzed, highlighting the practical and theoretical challenges arising from its implementation. Finally, the research evaluates the impacts of this change on the uniformity of judicial decisions and the safeguarding of fundamental rights.
