O reexame fático-probatório e a revaloração probatória em recursos especiais

Abstract

O objetivo geral do presente estudo é analisar os limites de aplicabilidade entre o reexame fático-probatório e a revaloração probatória no âmbito do recurso especial, com foco na interpretação conferida pelo Superior Tribunal de Justiça (STJ). A pesquisa é desenvolvida a partir de abordagem dedutiva, com base qualitativa, de natureza teórica, descritiva, bibliográfica e documental. A metodologia adotada contempla o estudo da doutrina, da legislação e da jurisprudência, com destaque para a Súmula n. 7 do STJ, buscando compreender como a Corte tem delimitado a admissibilidade de recursos especiais em que se discute a análise de provas. O trabalho foi estruturado em três capítulos: inicialmente, são apresentados os fundamentos gerais dos recursos e seus efeitos; em seguida, examina-se o recurso especial; por fim, o estudo se aprofunda na distinção entre reexame fático-probatório e revaloração probatória, à luz da jurisprudência dominante do STJ. Os resultados indicam que o STJ tem reiterado a impossibilidade de reexame de provas, com base na Súmula n. 7, ressalvando, contudo, a possibilidade de revaloração jurídica de provas já constantes nos autos. A Corte tem se posicionado no sentido de que, desde que não haja necessidade de nova incursão fática, é admissível a revisão da valoração atribuída pelo tribunal de origem. Porém, observa-se certa dificuldade prática na delimitação objetiva entre ambas as figuras, o que contribui para a elevada taxa de inadmissibilidade dos recursos especiais. Conclui-se que a correta compreensão das distinções entre reexame e revaloração é essencial para a adequada atuação dos operadores do direito e para o fortalecimento da função uniformizadora da jurisprudência exercida pelo STJ.

The general objective of this study is to analyze the limits of applicability between the factual-evidence re-examination and the evidentiary revaluation in the context of the special appeal, focusing on the interpretation given by the Superior Court of Justice (STJ). The research is developed from a deductive approach, with a qualitative basis, of a theoretical, descriptive, bibliographic and documentary nature. The methodology adopted contemplates the study of doctrine, legislation and jurisprudence, with emphasis on Summary no. 7 of the STJ, seeking to understand how the Court has delimited the admissibility of special resources in which the analysis of evidence is discussed. The work was structured in three chapters: initially, the general foundations of the appeals and their effects are presented; then, the special appeal is examined; finally, the study delves into the distinction between factual-evidence re-examination and evidentiary revaluation, in the light of the dominant jurisprudence of the STJ. The results indicate that the Superior Court has reiterated the impossibility of re-examination of evidence, based on Summary No. 7, excepting, however, the possibility of legal revaluation of evidence already contained in the records. The Court has positioned itself in the sense that, provided that there is no need for a new factual incursion, the revision of the valuation attributed by the court of origin is admissible. There is, however, some practical difficulty in the objective delimitation between both figures, which contributes to the high rate of inadmissibility of special resources. It is concluded that the correct understanding of the distinctions between re-examination and revaluation is essential for the proper performance of law operators and for the strengthening of the standardizing function of the jurisprudence exercised by the Superior Court.
