A produção de provas digitais localizadas em servidores estrangeiros no processo penal: Uma análise da Ação Declaratória de Constitucionalidade n° 51/DF

Abstract

O presente trabalho de conclusão de curso tem o objetivo de analisar a Ação Declaratória de Constitucionalidade (ADC) 51/DF, um caso paradigmático que versa sobre a cooperação jurídica internacional e a obtenção de provas digitais, frente aos desafios impostos pelo avanço tecnológico e a globalização. A pesquisa investiga a constitucionalidade do Decreto nº 3.810/2001 e de dispositivos do CPC e CPP, buscando compreender como o sistema jurídico brasileiro se adapta à complexidade dos crimes transnacionais no ambiente digital. O método empregado envolve a análise da decisão do STF, bem como a revisão de literatura especializada em Direito Penal Internacional, Direito Processual Penal e Direito Digital. Discute-se a dificuldade em lidar com as Big Techs, que controlam vastos volumes de dados de usuários brasileiros, e como a necessidade de obter informações sob a sua custódia esbarra em questões de soberania e jurisdição. O estudo também a natureza "aterritorial" dos dados, que desafiam a tradicional lógica de jurisdição territorial. Os resultados apontam para a necessidade de um equilíbrio entre a cooperação jurídica internacional e a possibilidade de requisição direta de dados, conforme previsto no Marco Civil da Internet e na Convenção de Budapeste. A pesquisa conclui que a ADC 51/DF representa um marco importante na busca por um sistema de cooperação jurídica internacional eficiente e adequado aos desafios da era digital, sem comprometer os direitos fundamentais e a soberania nacional.

The following final course assignment has the point to analyze the Declaratory Action of Constitutionality (ADC) 51/DF, a paradigmatic case that deals with international legal cooperation and the obtaining of digital evidence, in the face of the challenges imposed by technological advancement and globalization. The research investigates the constitutionality of Decree No. 3,810/2001 and of provisions of the CPC and CPP, seeking to understand how the Brazilian legal system adapts to the complexity of transnational crimes in the digital environment. The method employed involves the analysis of the STF's decision, as well as the review of specialized literature in International Criminal Law, Criminal Procedural Law and Digital Law. The difficulty in dealing with Big Techs, which control vast volumes of data from Brazilian users, and how the need to obtain information under their custody clashes with issues of sovereignty and jurisdiction, is discussed. The study also addresses the low effectiveness of the MLAT in obtaining electronic data and the "aterritorial" nature of data, which challenge the traditional logic of territorial jurisdiction. The results point to the need for a balance between international legal cooperation and the possibility of direct requisition of data, as provided for in the Marco Civil da Internet and the Budapest Convention. The research concludes that ADC 51/DF represents an important milestone in the search for an efficient international legal cooperation system that is adequate to the challenges of the digital age, without compromising fundamental rights and national sovereignty.
