A efetividade da Resolução nº 487/2023 do Conselho Nacional de Justiça nas medidas de segurança de internação no Brasil

Abstract

O instituto da medida de segurança é aplicado aos indivíduos inimputáveis ou semi-imputáveis que cometem ato típico e ilícito e tem como justificativa formal o tratamento do agente de modo que cesse a sua periculosidade. Esse instituto foi tema de discussão, culminando na Resolução nº 487 do Conselho Nacional de Justiça. O presente trabalho foi desenvolvido com o objetivo de analisar se a referida Resolução teve efetividade em instituir uma política antimanicomial no Poder Judiciário, implementando a Convenção Internacional dos Direitos das Pessoas com Deficiência e a Lei n° 10.216/2001. Para isso, foi adotado o método indutivo, através de análise qualitativa de fontes documentais, bibliográficas e legislativas. O primeiro capítulo trata das origens e justificativas da medida de segurança, faz uma análise dos dispositivos legais relacionados e expõe as condições dos hospitais psiquiátricos. O segundo capítulo versa acerca das novas previsões relacionadas à medida de segurança desenvolvidas nas últimas duas décadas, destacando seus principais aspectos e repercussões, que levaram à publicação da Resolução nº 487. O terceiro capítulo expõe os principais pontos apreendidos da análise jurisprudencial realizada, buscando verificar se o Superior Tribunal de Justiça tem aplicado as medidas estabelecidas pela Resolução n° 487. Conclui-se que a Resolução não foi efetiva em implementar as medidas propostas e que as medidas de segurança continuam sendo aplicadas e executadas em caráter ilegal.

The legal instrument of the security measure is applied to individuals deemed not criminally responsible or of diminished responsibility who commit a criminal act that is both typified and unlawful. Its formal justification lies in the treatment of the individual in order to eliminate their dangerousness. This legal construct has been the subject of considerable debate, as it reflects the structural stigma and exclusion faced by individuals with mental disorders, culminating in Resolution No. 487 of the National Council of Justice (CNJ). This study aims to analyze whether the aforementioned Resolution has been effective in establishing an anti-asylum policy within the Judiciary, thereby implementing the Convention on the Rights of Persons with Disabilities and Law No. 10,216/2001. To this end, the inductive method was adopted, through qualitative analysis of documentary, bibliographical, and legislative sources. The first chapter addresses the origins and justifications of the security measure, provides an analysis of the relevant legal clauses, and describes the conditions of psychiatric hospitals. The second chapter discusses the new legal developments related to security measures over the past two decades, highlighting their main features and impacts, which led to the publishing of CNJ Resolution No. 487. The third chapter outlines the key findings from the jurisprudential analysis conducted, seeking to determine whether the Superior Court of Justice has applied the measures established by Resolution No. 487. It is concluded that the Resolution has not been effective in implementing the proposed measures, and that security measures continue to be applied and enforced in an unlawful manner.
